Welcome to McDougleChiropracticMethods.com (the "Site"), a collaborative Chiropractic Technique resource. The term collaborative is used because the end will be the result of my efforts and your critique and input.

By accessing McDougleChiropracticMethods.com, or by submitting the registration information (at which point we ask you to agree to the Terms of Use) you create an agreement with us.  Under this agreement, you agree to be bound by these Terms of Use as amended from time to time. In return, we agree to allow you to access and use the Site. Please take the time to read these terms of use carefully as they contain important information regarding your legal rights remedies and obligations. These include various limitations and exclusions.  If you do not agree with these Terms of Use, please do not register McDougleChiropracticMethods.com, or access the site. However, please be advised that these terms are standardized for the protection of the proprietary information present on this site.

Content on the Site is provided for educational purposes only, and is provided for use by Chiropractic or Osteopathic professionals. Chiropractic and Osteopathic practitioners must make their own independent assessment before suggesting a diagnosis or recommending or instituting a course of treatment. The Site in no way should be seen as a replacement for consultation with colleagues and /or other sources, nor as a substitute for conventional training and study.

If you are not professionally qualified and are registering as a lay person, you further acknowledge that the content on the Site is provided for educational purposes only, and is provided for use by specific healthcare professionals.  Use and registration by other than specified healthcare professionals will result in possible litigation and forfeiture of monies paid without recourse by the fraudulent registrant / subscriber not limited to payment for any legal fees for all parties involved. You also agree to use the information solely for your own private educational purposes and further agree not to share or disseminate information in any way to nonpaying persons this proprietary data developed by Dr. Todd McDougle.

Time Period

To ensure the maximum benefit for you to acquire the knowledge offered, a month to month option is not offered. The weeks expire quickly and your focus may get sidelined, so this site only offers the service in three and twelve month cycles. To help ensure your success, momentum is the key and once fully engaged in learning, your headspace will absorb the information available at record pace! Take a look at the options and consider that which will allow you to be engaged and ultimately successful in this rare opportunity.

Package Options

When picking up a new concept, there needs to be a systematic approach that will create the environment for success. For these reasons, there are options to accommodate you and your busy lifestyle. You can separate the areas of learning to focus on the specific area that you wish to learn more on or you can go ahead and pick up the entirety of these first two sections; CervicoThoracic and LumboSacroPelvic. The Special Tech section has yet to be finished as of this.

At the time of introduction of this site, one user per subscription to site may acquire usage for one section for a three month cycle will be US $80 per month, two sections for a three month cycle will be US $125 per month, Special Tech for a three month cycle will be US $125, two sections for a twelve month cycle will be US $1200 per year, and Special Tech for a twelve month cycle will be US $1200 per year.

The individual subscriber or representative shall be responsible for payment of site usage and any legal fees required to have paid for agreement in full. You agree to the terms of no refunds and will also agree to request no refund of any kind from third party administrators such as PayPal and their subsidiaries. Any cause to violate the no refund policy may involve litigation for which you will assume all financial obligations for all parties and herein agree to these terms.

Ownership and Licenses

User contributed image content

All image content which you may contribute to this Site, (i.e. radiology cases, including but not limited to X-rays, CT, MRI, Ultrasound, Angiography; images, diagrams and photos, but specifically excluding all text content), are unless otherwise agreed by MCM in writing at the time you contribute same, become property of McDougle Chiropractic Methods and its affiliates to be used as needed under the sole discretion of McDougle Chiropractic Methods and its affiliates.

Provided no copyright breach or license breach occurs, image content licensed under a different license (including but not limited to General Public License, Creative Commons licenses), may be obtained from a third party. In such cases the original license should be included in the image description, and reference to the original source made in the form of a URL.

Site image content (other than image content contributed by you) may not be modified, copied, distributed, reused, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part outside the bounds of the Site.

Text content

All text content on this site (including but not limited to articles, case descriptions, image descriptions and all communications you transmit to anyone through the Site) is the property of MCM, and unless otherwise agreed by McDougle Chiropractic Methods and its affiliates in writing, is licensed to you for your use only and are protected proprietary methods under the United States Copyright Laws.

Text content may not be modified, copied, distributed, reused, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part outside the scope of this license, without prior written permission from McDougle Chiropractic Methods and its affiliates.

Where you contribute any text content, you assign to MCM, free of charge and effective on making such contribution, all right, title and interest in such content (including any copyright, but excluding any non-assignable personal rights) and warrant that you are entitled to make such assignment.

Warranty

In respect of all content which you contribute to the Site (hereafter "Your Content"), you warrant that:

  • you have the right to contribute such content to the Site and to allow such content to be used in accordance with these Terms of Use
  • before contributing such content, you have removed all information by which any person could reasonably be expected to be identified

Moral rights etc.

Despite any provision to the contrary at law or under the Creative Commons copyright licenses also known as “CC License”, you consent to MCM making, and allowing third parties to make, any use of Your Content which would otherwise infringe any non-assignable personal rights which may subsist therein.

Modifications to CC license

You acknowledge that McDougle Chiropractic Methods is a "Collection" as defined in the CC license.  You further acknowledge that the CC license is amended as follows, in respect of Your Content:

  • MCM will endeavor to ensure appropriate attribution is made or is not made (as the case may be), but will not be liable in any way for failing to make appropriate attribution or failing to comply with any request to remove any attribution;
  • MCM may accept commercial sponsorship to contribute to the costs of operating its sites, including McDougle Chiropractic Methods;
  • While MCM will endeavor to comply with any written request from you to remove any content contributed by you, it is under no obligation to do so. You further agree that McDougle Chiropractic Methods’ license is perpetual and irrevocable.
  • The Governing Law, Venue and Jurisdiction provisions set out in these Terms below also apply to the CC license; and

Online Communities and Other Interactive Areas

The Site or affiliate sites (including Face Book and other forms of social media) of McDougle Chiropractic Methods eventually may contain areas where you may post and share comments with other Site users on a variety of subjects. You further expressly agree that you will not discuss, endorse or refer to “off label” uses of medical products, including any uses which have not been approved by the U.S. Food and Drug Administration or other applicable regulatory agency.

Our commitment to privacy

Your privacy is important to McDougleChiropracticMethods.com . To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used.

The information we collect about you

Required information for registration consists of:

  • Username and password
  • Surname
  • First name
  • Position (professional)
  • License Number(s)
  • Country
  • email address

Additional information including, but not limited to, city, institution and title can also be entered during registration and on your user profile page and may be required by interfaces such as PayPal (Who have their own privacy policies) to successfully begin your journey on our Site.

As some of the site may eventually be contributed by users, it may be that further personal information is posted by individual users.

The way we use information

Email address

The email address you provide us is very important to our communication with you. Your email address is used in four distinct ways.

First, your email address will be used to allow users of McDougle Chiropractic Methods by you as the Doctor so as to contact you via ‘contact user’ link in your profile which will be an option at a later date as our Doctor database grows. Until when such contact is initiated, your email address remains hidden. You may be able to opt-out of being contacted by other users / potential patients in your area in your profile settings if you so choose to do so.

Second, the editorial board may contact you in regards to your contributions and your financial issues. In doing so, an email will be sent to the address you provided. You cannot opt-out of this type of communication.

Third, to facilitate communication with you in a professional way, including managing unsubscribe requests and newsletter publishing, your email address will be upload to a trusted third party service provider which is handles these kind of services. For newsletters or other opt-in communications, you can always opt out of receiving these emails. We typically will use methods such as Mail Chimp to accomplish these group communications.

Finally, very rarely, McDougle Chiropractic Methods may need to send important announcements to you, such as changes to this privacy policy or alterations to the site’s terms of use. You cannot opt out of this kind of email. However, in six years of operation, MCM has only done this one time.

Other information

We use non-identifying and aggregate information to better design our website and to share with advertisers / sponsors. For example, we may tell an advertiser that X number of individuals visited a certain area on our website, or that Y number of registrars or consultants are registered members, but we would not disclose anything that could be used to identify those individuals.

Finally, we never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

Anonymity of cases / images

All cases submitted should be de-identified, in such a way as to leave no way of identifying an individual patient. Information which should NOT appear on any of the cases includes (based on HIPAA guidelines), but is not limited to:

  • name
  • initials
  • date of birth
  • address, including full or partial postal code
  • telephone or fax numbers or contact information
  • e-mail addresses
  • unique identifying numbers (e.g. UR, MRN, HID etc..)
  • vehicle identifiers
  • medical device identifiers (e.g serial numbers)
  • web or internet protocol addresses containing any link to the patient
  • biometric data
  • facial photograph or comparable image
  • names of relatives
  • date of study

Additionally if a case is for one reason or another unique in such a way that could lead to identification of an individual from the images alone then it should also not be uploaded. This means that a case which is has, for example, been featured in the media is usually inappropriate for upload.

Similarly the textual information accompanying the text should also be devoid of identifying information, and devoid of other unnecessary information which could aid in the identification of a patient.

Note: Our privacy policy does not override the individual policies of institutions and users should ensure that they are using images within their local guidelines.

We take this very seriously, and failure to abide by these rules a breach of our privacy policy and terms of use. If you upload a case with patient information, your case will be immediately deleted and if you repeatedly upload cases with patient details your account will be suspended.

Termination 

McDougle Chiropractic Methods may, as it sees fit, for any reason or no reason at all, without liability to you or any third party, terminate your registration or your access to the Site.   If we exercise any such termination right we will send an e-mail to the e-mail address we then have with your registration details and termination will be effective upon us sending that e-mail (and will be considered effective even if the e-mail is not delivered for any reason).

You may terminate your registration for any reason at any time but will be expected to pay for and complete the 3 or 12 month term initially agreed upon. There will be Absolutely No Refunds. Governing Law; Venue and Jurisdiction

These Terms of Use shall be governed by the laws of the State of Indiana in the United States of America.

Competent Jurisdiction

In the absence of mutual agreement, any dispute arising from the interpretation and/or performance of the present Terms of Use shall be submitted to the exclusive jurisdiction of the competent American Courts, of the State of Indiana.

Effective Date, Amendment and Severability

These Terms of Use are effective as of 1st January 2015.  McDougle Chiropractic Methods may from time to time change these Terms of Use by posting the amended terms to the Site.  Your continued use of the Site after any changes become effective means you accept such changes.  If you do not agree to any changes, you must not continue to use the Site. Some advancements within this site may require additional fees and may not be considered a part of the initial agreement / contract but will maintain the clauses and restrictions previously referred.

Except solely as provided in this paragraph, these Terms may not be changed without the handwritten (non-electronic) signature of an authorized representative of McDougle Chiropractic Methods.  If any provision of these Terms are held unenforceable, the remaining portions shall remain in full force and effect yet it is agreed that the subscriber will not remain harmless in violation of this agreement and shall affirm that they will pay for all legal fees in regards to involvement of the legal system and its subordinates.

Entire Agreement 

These Terms contain the entire understanding and agreement between you and McDougle Chiropractic Methods regarding McDougleChiropracticMethods.com, and supersedes all prior and contemporaneous agreements and understandings between us regarding such subject matter.

Affirmation of Agreement

Entrance into this site requires your agreement to the terms and conditions of the aforementioned. Only then will you have access to this site.
